Administrative Law

Administrative law encompasses the California professional licensing disciplinary hearing process. Any individuals with a professional license issued from a California administrative licensing agency, board, bureau or department is subject to that respective entities' rules and regulations. Complaints made to an administrative law agency can result in an investigation and filing of an accusation against one's professional license.

Disciplinary Hearings are heard before an Administrative Law Judge employed by the California Office of Administrative Hearings. At that Hearing, the California licensing entity is represented either by the California Attorney General's Office or in house staff attorneys. Both sides can cross examine witnesses and present evidence. In many cases, it is possible to reach an agreement, called a Stipulated Agreement, with the board prior to the hearing to keep a client's professional license.

Statement of Issues

Individuals denied a professional license by a California administrative agency, board, bureau or department have the right to contest the decision. The document issued by the California agency denying the license is called the Statement of Issues. The decision is contested at a Hearing before an Administrative Law Judge employed by the California Office of Administrative Hearings.

The Board is generally represented by the California Attorney General's Office, but sometimes by the Board's own staff attorneys. At the Hearing, both the Board and the respondent have the right to cross examine witnesses and present evidence. In many cases, it is possible to reach an agreement with the Board prior to the Hearing and secure a client's professional license.
